Terms of service
OVERVIEW
This website is operated by Adam Biernat Studio, an independent fine art studio serving collectors around the world with a deep commitment to quality, transparency, and service. I work with top-tier partners in the United States and have optimized my entire process for collectors. I've built this experience to be seamless and trustworthy — from fully insured shipping to a Lifetime Fade Warranty. You're in excellent hands.
All artworks are custom-framed in Los Angeles, California.
Each piece is first printed, signed, and carefully inspected personally by me, Adam Biernat, in my studio, then shipped via FedEx (2–4 business days in transit) — carbon-offset through Shopify Planet — to Los Angeles for custom framing and final assembly.
I’ve successfully delivered more than 2,000 artworks to collectors across 5 continents. Every order is securely packaged, and fully insured in transit.
The store runs on Shopify Inc., which provides the platform that powers all purchases and transactions.
By using this website and/or purchasing artwork, you agree to be bound by these Terms of Service, as well as any additional policies referenced here.

1. Intellectual Property & Copyright
All photographs, images, text, and content on this website are the exclusive intellectual property of Adam Biernat and are protected by international copyright laws. Unauthorized reproduction, distribution, or modification of any content is strictly prohibited and will be prosecuted to the full extent of applicable copyright and intellectual property law.
2. Color Accuracy Disclaimer
Every artwork is printed using a color-managed workflow: I use a professionally calibrated monitor, archival-grade pigment inks, and museum-quality Hahnemühle Photo Rag paper to ensure exceptional color accuracy and consistency in every print.
However, please note that colors may appear slightly different depending on your device’s screen settings, brightness, or ambient lighting. While I strive for precise reproduction, I cannot guarantee exact color matching on all viewing devices.
3. Shipping & Fulfillment
All framed artwork is shipped from Los Angeles, California, via FedEx Ground (4-5 business days in transit) or FedEx Freight (4-5 business days in transit) for giant pieces bigger than 36″ × 48″, only within the contiguous United States (excluding Alaska and Hawaii), and fulfillment typically takes 3–5 weeks.
Each order is securely packaged and fully insured for transit.
Shipping:
- Standard delivery: $50 (all artworks up to 30″ × 40″, charged once per order)
- Freight delivery on a secure pallet: $450 (artworks larger than 30″ × 40″, charged once per order)
Shipping emissions are carbon-offset through the Shopify Planet program.
Collectors outside the U.S. are warmly invited to contact me directly — I’m happy to personally assist with international orders.
Signature Required on Delivery
All orders with a total value of $1,000 or more are shipped with signature required upon delivery to ensure a secure handover of your artwork.
If no one is available to sign at the time of delivery, FedEx may attempt redelivery or provide further instructions according to their standard procedures.
Freight Delivery for Oversized Artworks (larger than 30″ × 40″)
My larger artworks are shipped on a secure pallet via FedEx Freight to ensure maximum protection in transit.
If your order includes an artwork larger than 30″ × 40″, FedEx will contact you in advance to schedule a delivery appointment. An adult must be present at the delivery address to receive and sign for the freight shipment.
If a delivery appointment is scheduled and no adult is present at the time of delivery, FedEx will assess an additional redelivery and storage fee. Any such fees charged by the carrier are the responsibility of the collector.
4. Damages and Issues
If your artwork arrives damaged or incorrect, please let me know right away.
Send an email to adam@adambiernatstudio.com within 7 days of delivery (as confirmed by the carrier’s delivery record), along with photos of the damage and both the inner and outer packaging.
Once all required information has been received, a replacement will be issued at no cost.
5. Returns & Refunds
Because each artwork is made to order and custom-framed specifically for the collector, all sales are final. Returns or cancellations are not accepted once an order has been placed. By placing an order, you expressly acknowledge and agree to these terms as a collector.
6. Cancellations
All artworks are made to order and enter production immediately after an order is placed. For this reason, orders cannot be cancelled once submitted.
7. Exchanges
I don't offer exchanges.
8. Lifetime Fade Warranty
All artworks are covered by a Lifetime Fade Warranty. Your artwork is guaranteed not to visibly fade under normal display conditions.
If your artwork ever shows visible signs of fading under those conditions, simply reach out — I will replace it at no cost to you.
Normal display conditions mean:
- The artwork is displayed indoors, in a residential or commercial interior.
- It is not exposed to direct, prolonged sunlight (such as hanging in front of or directly opposite uncovered windows with strong sun exposure).
- It is not exposed to excessive heat, humidity, or moisture.
- It is not displayed outdoors or in unconditioned spaces (such as bathrooms without ventilation, saunas, or pool areas).
9. Payment & Taxes
I accept all major credit cards through Stripe, as well as PayPal. Payments are processed securely.
All prices include applicable sales tax where required.
10. Custom Orders
I gladly accept custom orders, such as custom sizes or framing requests (e.g., mats). Please contact me at adam@adambiernatstudio.com to discuss your request.
Please note that I do not sell digital files or downloadable products.
